Terms and Conditions-الشروط والأحكام

Before using the 2days platform and application, please read these terms and conditions carefully. By using the application, you agree to comply with all that is stated in this document and you bear responsibility.

1. Definitions:
- (Application): This electronic platform that provides mediation services between two parties.
- (Advertiser): Any person or entity using the application to advertise the rental or sale of products and services.
- (Client): Any person or entity using the application to rent or purchase products and services.
- (User): Anyone who uses the application.
- (Advertisement): The advertisement published by the advertiser in the application to showcase products or services.

2. Terms of Use and User Responsibility:
- The user must be of legal age (18 years or older) to use the application.
- The application may only be used for legal purposes.
- The user bears responsibility for the products and services they request or that are advertised.
- The user bears full responsibility for the accuracy of the information and data in their entire account.
- The client must be serious in their request for rental or purchase submitted to the advertiser and must not refuse to receive the product or service after paying for it unless it has defects or does not match the description and images of the advertisement.

3. Conditions for Publishing Advertisements:
- Advertisements must be clear and accurate, including product or service details such as the advertisement title, description, price, and images.
- The advertiser must not manipulate or alter advertisement information in misleading or untrue ways.
- Publishing advertisements for prohibited or illegal products or services such as weapons or narcotics is prohibited.
- Any advertisement containing illegal content or violating public morals, or conflicting with intellectual property rights is prohibited.
- The advertiser is responsible for ensuring that advertisements do not infringe upon intellectual property rights or data protection laws.
- The 2days platform and application charge the advertiser a fee ranging from 3% to 5% on each transaction between two parties.
- The advertiser is solely responsible for the accuracy of their bank account details or mobile number on STC Pay when requesting to withdraw the balance from their wallet in the application.

4. Intellectual Property Rights:
- All rights related to the application (including design, programming, and content) are the exclusive property of the owners of the 2days platform and application.
- Copying or redistributing any content from the 2days application without prior written permission from the owners is prohibited.

5. Privacy and Data Protection:
- Personal data of the user is collected and used in accordance with the privacy policy of the 2days application as outlined on the privacy page.
- The application is committed to protecting the privacy of users and personal data will not be shared with third parties without their consent.

6. Amendments to Terms and Conditions:
- The 2days platform and application reserve the right to amend these terms and conditions at any time, and the amendments will take effect immediately upon publication.
- Users must periodically review the terms and conditions to ensure continued use in accordance with the latest versions.

7. Suspension or Cancellation of Account:
- The management of the 2days platform and application has the right to suspend or cancel the user's account if they violate any terms of use or cause harm to the application or other users.
- If the user's account is suspended or canceled, they lose all rights to access the services of the application.

8. Limits of Liability:
- The 2days platform and application shall not be liable for any losses or damages that the user may incur as a result of using the application.
- The 2days platform and application are not responsible for any issues that may arise between the client and the advertiser, such as financial or legal problems.

9. Governing Laws:
- These terms and conditions are governed by the local laws of the Kingdom of Saudi Arabia.
- In the event of any dispute, it shall be resolved in the courts of the relevant state.

  قبل استخدامك لمنصة وتطبيق يومين يُرجى قراءة هذه الشروط والأحكام بعناية. باستخدامك للتطبيق، فإنك توافق على الالتزام بجميع الموضح في هذه الوثيقة وتتحمل المسؤولية.

1. التعريفات:
- (التطبيق): هذه المنصة الإلكترونية والتي تقدم خدمة الوساطة بين طرفين.
- (المعلن): أي شخص أو كيان يستخدم التطبيق للإعلان عن تأجير أو بيع المنتجات والخدمات.
- (العميل): أي شخص أو كيان يستخدم التطبيق لاستئجار أو شراء المنتجات والخدمات .
- (المستخدم): كل من يستخدم التطبيق.
- (الإعلان): الإعلان الذي ينشره المعلن في التطبيق لعرض المنتجات أو الخدمات .

2. شروط الاستخدام ومسؤولية المستخدم:
- يجب أن يكون المستخدم قد بلغ السن القانوني (18 عامًا أو أكثر) لاستخدام التطبيق.
- يُسمح استخدام التطبيق لأغراض قانونية فقط.
- يتحمل المستخدم مسؤولية المنتجات والخدمات التي يطلبها أو التي يعلن عنها أمام الجهات الأمنية .
- يتحمل المستخدم المسؤولية الكاملة عن صحة المعلومات والبيانات في كامل حسابه.
- يجب على العميل أن يكون جاد في طلب الاستئجار أو الشراء المقدم للمعلن وأن لا يرفض استلام المنتج أو الخدمة بعد دفع قيمتها ما لم يكن بها عيوب أو ليست مطابقة لوصف وصور الإعلان.

3. شروط نشر الإعلانات:
- يجب أن تكون الإعلانات واضحة وصحيحة، بما في ذلك تفاصيل المنتج أو الخدمة مثل عنوان الإعلان والوصف والسعر والصور.
- يجب على المعلن عدم التلاعب أو تغيير معلومات الإعلان بطرق مضللة أو غير حقيقية.
- يُمنع نشر إعلانات عن منتجات أو خدمات محظورة أو غير مشروعة مثل الأسلحة أو المواد المخدرة .
- يُمنع نشر أي إعلان يحتوي على محتوى غير قانوني أو مخل بالآداب العامة، أو يتعارض مع حقوق الملكية الفكرية.
- المعلن هو المسؤول أن الإعلانات لا تنتهك حقوق الملكية الفكرية أو قوانين حماية البيانات.
- منصة وتطبيق يومين تفرض رسوم على المعلن تتراوح بين 3% الى 5% على كل صفقة تتم بين طرفين.
- المعلن وحدة المسؤول عن صحة بيانات حسابه البنكي أو رقم جواله على STC Pay عند طلبه سحب الرصيد من محفظته بالتطبيق.

4. حقوق الملكية:
- جميع الحقوق المتعلقة بالتطبيق (بما في ذلك التصميم، البرمجة، والمحتوى) هي ملكية حصرية لملاك منصة وتطبيق يومين .
- يمنع نسخ أو إعادة توزيع أي من محتويات تطبيق يومين بدون إذن خطي مسبق من الملاك.

5. الخصوصية وحماية البيانات:
- يتم جمع واستخدام البيانات الشخصية للمستخدم وفقًا لـ سياسة الخصوصية الخاصة بتطبيق يومين والموضحة في صفحة الخصوصية.
- يلتزم التطبيق بحماية خصوصية المستخدمين ولن يتم مشاركة البيانات الشخصية مع أطراف ثالثة بدون إذن منهم .

6. التعديلات على الشروط والأحكام:
- تحتفظ منصة وتطبيق يومين بحق تعديل هذه الشروط والأحكام في أي وقت، وتصبح التعديلات سارية فور نشرها.
- يجب على المستخدمين مراجعة الشروط والأحكام بشكل دوري لضمان استمرارية الاستخدام وفقًا لأحدث النسخ.

7. تعليق أو إلغاء الحساب:
- يحق لإدارة منصة وتطبيق يومين تعليق أو إلغاء حساب المستخدم في حال ارتكب أي مخالفة لشروط الاستخدام أو التسبب في ضرر للتطبيق أو المستخدمين الآخرين.
- إذا تم تعليق أو إلغاء حساب المستخدم فإنه يفقد كافة الحقوق في الوصول إلى خدمات التطبيق.

8. حدود المسؤولية:
- لا تتحمل منصة وتطبيق يومين أي مسؤولية عن أي خسائر أو أضرار قد يتعرض لها المستخدم نتيجة استخدامه التطبيق.
- منصة وتطبيق يومين ليست مسؤولة عن أي مشاكل قد تحدث بين العميل والمعلن مثل المشاكل المالية أو القانونية .

9. القوانين الحاكمة:
- تخضع هذه الشروط والأحكام للقوانين المحلية في المملكة العربية السعودية .
- في حال حدوث أي نزاع، يتم تسويته في محاكم الدولة المعنية.
